Will CBA legitimation votes eliminate protection contracts?

Four years after the launch of Mexico’s labour justice reform, legitimation votes on all existing collective bargaining agreements (CBAs) were to be completed by May 1, 2023. Mexico’s labour authorities extended that deadline to July 31, while requiring that unions register the dates of such votes by May 1. If legitimation votes have not been carried out or programed by May 1, or are programed but are not held before July 31, the CBA is terminated.

Mexico: Independent unions win significant wage increases

Independent unions at five manufacturing facilities in Mexico, most of which are in the auto manufacturing and auto parts sectors, have recently negotiated significant wage increases for their members. 

Contributing factors that helped achieve these victories are: 1) the right of workers under Mexico’s labour justice reform to vote by secret ballot on existing collective bargaining agreements and in union representation elections, and 2) the right to file complaints if workers’ associational rights are violated under the tri-national trade agreement.

On August 31, 2022: workers at the Manufacturas VU maquila factory in Piedras Negras, Coahuila participated in their first democratic election on who would represent them in negotiations with their employer on their wages, working conditions, and rights at work.

295 workers took part in the secret-ballot vote to choose between two unions: the Confederation of Mexican Workers (CTM) or the Mexican Labour Union League (La Liga). By the end of the day, the workers’ response was overwhelming: 186 votes for La Liga and 101 for the CTM.
